Contest/Challenge Legal Terms and Conditions
1. Eligibility and Entry Period:
In order to be eligible, Participants must comply with all of the Terms and Conditions, herein. The Challenge is open to Participants of all ages, but Participants who are minors (under 18 years of age) must have permission from their parent or legal guardian to enter. All Participants must be current residents of one of the 50 United States, the District of Columbia, or a US Territory. By submitting an Entry, you confirm compliance with these rules.
The Challenge will be void and/or Participants rendered ineligible where legally prohibited. ArtSkills, in its sole discretion, shall determine the eligibility of Participants. Employees, owners, officers, and directors of ArtSkills, its marketing agents (and their subsidiaries and affiliates), and legal advisors, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in the Challenge.
The Challenge will open at 12:00 AM on February 8, 2025, and close at 11:59 PM on March 7, 2025 (the “Entry Period”).
2. How to Enter:
Participants will (a) create a dessert-themed or candy-themed craft using ArtSkills supplies, (b) post a photo or video of your craft on social media, and (3) tag us @ArtSkills and use #ArtSkillsInAction in your post on Instagram, Facebook, or TikTok.

3. Submission Agreement:
By submitting your project (photo, video, and/or description), you grant ArtSkills, Inc., a perpetual, royalty-free, worldwide license to use, reproduce, distribute, display, and create derivative works from your submission in any media, including without limitation social media, websites, marketing materials, and video compilations, without compensation or notification.
4. Ownership of Your Work:
You retain ownership of your project and submission, but by entering, you are expressly permitting ArtSkills, Inc., to showcase and feature your work in its promotional efforts as detailed herein.
5. Selection and Notification of Winner:
ArtSkills will select a total of one (1) Grand-Prize Winner (the “Winner”) among all eligible Entries received during the Entry Period and such Winner will be announced publicly on Instagram, Facebook. and TikTok on or around March 20, 2025. All decisions by ArtSkills are final and binding in all matters relating to this Challenge. Odds of winning depend on the total number of Entries received. Odds of winning are increased if you submit multiple Entries during the Entry Period. Participants may submit as many Entries as they desire during the Entry Period.
The Winner may be required to sign and return within five (5) days of notification an affidavit of eligibility and release of liability. If a potential Winner of the Prize cannot be contacted, fails to provide any requested information within the specified time period, or the Prize is returned as undeliverable, the potential Winner shall forfeit the Prize and ArtSkills will award the Prize to an alternate Winner, selected in accordance with these Terms and Conditions. Use of a false name or address will disqualify an Entrant. ArtSkills reserves the right to oblige any potential Winner to provide documentary proof of their identity.
6. Judging and Prizes:
Entries will be judged based on creativity, effort, alignment with the theme, and use of ArtSkills supplies. The Winner will be contacted before March 20, 2025, via social media direct message on their submitted post. One Grand Prize will be awarded in the form of ArtSkills crafting products with a combined retail value of at least $150.00. All prizes are non-transferable, non-substitutable, and may not be redeemed for merchandise or cash. ArtSkills reserves the right to substitute prizes of equal or greater value. All applicable federal, state, and local taxes are the responsibility of the Winner.
7. No Purchase Necessary:
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN AND A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
8. Rights to Modify or Cancel:
ArtSkills, Inc., reserves the right to modify or cancel the Challenge at any time without prior notice.
9. Publicity Release:
By entering, you (and, if you are a minor, your parent or legal guardian) consent to the use of your name, likeness, and Entry in promotional content related to the Challenge without further approval, notice, or compensation.
10. REPRESENTATIONS & WARRANTIES. By submitting your Entry into the Challenge, you represent and warrant that: (i) you have all rights, power, authority and necessary consents or permission to enter the Challenge, (ii) you are the Authorized Holder of the direct messaging and social media account used to enter the Challenge, and (iii) you are in compliance with these Terms and Conditions.
11. RELEASE. BY SUBMITTING AN ENTRY, YOU AND EACH OF YOUR HEIRS, SUCCESSORS AND ASSIGNS RELEASES AND AGREES TO HOLD HARMLESS ARTSKILLS AND ITS PARENT, SUBSIDIARIES, AND AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, INSPECTORS AND AGENTS FROM ANY LIABILITY WHATSOEVER (WHETHER ARISING IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY) FOR ANY CLAIMS, COSTS, LOSSES, OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, THOSE RELATED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH: (I) SUBMITTING AN ENTRY; OR (II) OTHERWISE ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE CHALLENGE.
12. DISCLAIMER AND LIMITATION OF LIABILITY. ARTSKILLS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ENTRANT'S PARTICIPATION IN THE CHALLENGE. ARTSKILLS SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM OR RELATES TO PARTICIPATION IN THE CHALLENGE OR BEING SELECTED. ArtSkills is not responsible for ineligible, incomplete, mutilated, lost, late or postage due Entries. ArtSkills is also not responsible for technical failures of any kind, including without limitation any website, any internet connection problems, technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any email or Entry to be received on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an Entrant’s computer or electronic device or any other person's computer or electronic device, all of which may affect the Entrant’s ability to participate. ArtSkills reserves the right to disqualify any Entrant and to seek any remedy at law or equity in the event you, in ArtSkills’ reasonable opinion, tamper with any website or the Entry process, violate the Terms and Conditions herein, or act in an unsportsmanlike or disruptive manner. We suggest you retain copies of your Entry. Entries may be retained, published, or disposed of at ArtSkills’ discretion and will not be returned. ArtSkills, in its sole discretion, reserves the right to disqualify any person tampering with the Entry process, the operation of the website or who is otherwise in violation of the Terms and Conditions. It further reserves the right to cancel, terminate or modify any Challenge not capable of completion as planned, including infected computer virus, bugs, tampering, unauthorized intervention, loss of data or technical failures of any sort.
13. PROMOTER, GOVERNING LAW, ETC.:

This Challenge is governed by the laws of the Commonwealth of Pennsylvania, and all cases and claims pertaining to this Challenge must be brought in a court of competent jurisdiction located in Pennsylvania.

15. Agreement to Rules:
Participation in the Challenge constitutes full and unconditional agreement to these Terms and Conditions.
